Utah Governor Spencer J. Cox has signed new legislation (Senate Bill 233), effective May 3, 2023, permitting public and private entities to offer a portable benefit plan to gig workers and other independent contractors that includes health insurance coverage or unemployment benefits. The bill specifies that offering a portable benefit plan and contributions do not: (1) constitute that an employment relationship exist, (2) establish employer liability, or (3) determine employee status for workers' compensation or unemployment purposes.
